Court of Civil Appeal: Vote Yes.

The proposal to establish a new dedicated Court of Civil Appeal is a welcome and long overdue change. At present, despite the positive changes brought in by the Chief Justice Susan Denham, the work of the Supreme Court remains massively overwhelming. Cases lodged today may not be heard until 2017 at the earliest due to this workload. As a direct result our Supreme Court is failing to provide the essential and timely justice it is needed for.

Clearly, this problem had to be tackled by constitutional change and I support this effort. I also support the removal of the requirement on the Supreme Court to isse ‘single judgment’ opinions – where the Court is required to speak with one voice even if some of the justices disagree. There is always a place for the minority opinion in our democratic life and this should be reflected in our highest institutions.
